Joel Johnston, an environmental and regulatory attorney at national law firm Hall Estill, also remarked on the impact of the highest court in the land’s decision. “This decision, one the Court grounded in property law, certainly has positive ramifications for the Atlantic Coast Pipeline, but other infrastructure projects, especially linear ones such as pipelines and transmission lines, will certainly benefit as well, though benefits will primarily be confined to projects that need right-of-way easements to cross the subsurface of lands where the U.S. Forest Service has granted a trail easement to the National Park Service for one of the almost two dozen National Trails.
