OTC Report of Potential Impact of McGirt v. Oklahoma

On September 30, 2020, the Oklahoma Tax Commission ("OTC") issued a Report of Potential Impact of McGirt v. Oklahoma, 519 U.S.___(2020) to the Oklahoma Commission on Cooperative Sovereignty, to discuss the significant immediate and fiscal impact resulting from the expanded boundaries of the Muscogee (Creek) Nation under McGirt to the OTC. The OTC anticipates the primary fiscal impact of McGirt will be reflected in reduced collections of individual income tax sales/use tax, due to the increased numbers of Creek Nation tribal members eligible to earn exempt income and make purchases exempt from sales/use tax.
