Litigation Case Results

• Two court victories obtained by Hall Estill for a publicly-held client, paved the way for a shareholder vote allowing our client to acquire another business in a $1.6 billion merger.  Recently, the Oklahoma County District Court granted our client's Motion to Stay shareholder litigation seeking to enjoin the merger vote.  In July 2010, in an emergency proceeding, the Chief Justice of the Oklahoma Supreme Court denied a shareholder attempt to enjoin the merger.
• Obtained a jury verdict of $8.7 million in favor of firm's client, a national gas gathering company.
• Prevailed on Motion to Compel Discovery, as well as finding an arbitration clause lacked mutuality. Arkansas Supreme Court ruled in clients' favor, affirming the Arkansas Court of Appeals ruling and sending case to the circuit court where clients will have a jury trial.
• Obtained an $8.7 million verdict in favor of the firm's client, an interstate gas transmission and supply company, against the City of Detroit after trial in the U.S. District for the Eastern District of Michigan.
• Prevailed on Motion for Summary Judgment for our clients against claims made by another company against our clients of $555 million.
• Defended the largest asbestos contamination case to date in Oklahoma.
• Obtained dismissal of director of NYSE-listed company in shareholders derivative suit.
• Negotiated $1 million settlement for client in fiber cut case
• Settled class action securities fraud claims against lawyers in largest bank failure litigation in United States for pennies on the dollar.
• Settled multiple class action securities litigations against Big Five accounting firm client on favorable terms.
• Obtained injunctive relief against State of Oklahoma for international drug manufacturer, reversing removal of drug from state Medicaid formulary, insuring $3.5 million per year income stream to client.
• Obtained injunctive relief against Attorney General of the United States and Department of Justice preventing enforcement of Indian gaming laws against client manufacturer of gaming devices.
• Obtained summary judgment for Fortune 500 company in Federal Court terminating coal lease, saving client in excess of $2 million in royalties, and obtained affirmance in Sixth Circuit Court of Appeals.
• Currently representing Fortune 500 company’s officers and directors in 11 securities class actions.
• Successfully defended a nationwide blood bank operation in a three-week federal jury trial against allegations of Hepatitis C infection allegedly caused by a blood transfusion.
• Successfully defended a large natural gas pipeline company in a rural Oklahoma trial against allegations that construction blasting caused the destruction of a nearby home.
• Successful defense of nationwide class action securities fraud claims against publicly traded issues.
• Defense of oil and gas producers in multiple state class actions.
• Obtained federal recognition of trade dress of a national car rental company.
• Successfully concluded telecommunications contract dispute resulting in payments in excess of $350 million to client.

• Multi-million dollar jury verdict in federal court trial arising out of construction contract dispute.
• Significant arbitration award involving allegations of design delays.
• Obtaining injunctive relief to protect confidential company information and trade secrets.
• On behalf of one of the world's largest pharmaceutical companies, we obtained an injunction against the state from an elected state district judge in the capital city, overturning emergency rules of the state Medicaid patients; saving our client in excess of $3 million.
• Negotiated for the State of Oklahoma, a joint operating agreement combining the university teaching hospitals with a large private hospital, in which both sides shared control and budgeting 50/50, while the state received $40 million cash; the first $7 in annual income and $26 million annually for the University of Oklahoma Medical School.
• Obtained federal protection of trade dress on behalf of multi-national car rental client.
• Successfully obtained or defended against scores of temporary restraining orders/preliminary injunctions relating to intellectual property.
• Successfully prevented use of misappropriated intellectual property in unfair competition with manufacturing, services, securities brokerage, insurance, accounting and marketing clients.
• Successfully enforced or defended against enforcement of scores of restrictive covenants in a variety of state and federal courts.
• Successfully represented U.S. importers in trade disputes with state-owned Russian companies.
• Formulating and directing major litigation on constitutionality of certain trade laws.
• Routinely obtain dismissal of libel, privacy and related claims on preliminary motion
• Successfully challenged as unconstitutional the confiscation by police without a warrant or hearing from video retailers of movies claimed to be, but which were not, pornographic
• Provided concise and effective First Amendment advice to major television networks, national newspapers and local media
• Successful representation of news organization in a defamation case in which the Court of Appeals issued an opinion reversing a multi-million dollar verdict against our client.
• Obtained a number of six-figure judgments for telecommunications clients in underground utility and facility damage cases, including a $375,000 jury verdict in federal court and the negotiation of settlements exceeding a half-million dollars.
• Obtained summary judgment and affirmance on appeal for an insurer’s national religious denominational insured in a clergy molestation case, avoiding a multi-million dollar potential judgment.
